Terms of Service

Effective date: August 1, 2026

These Terms of Service ("Terms") govern your use of the Have mobile application and the gethave.app website (together, the "Service"), operated by Northform ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Have helps you track the food you own, match recipes against your pantry, and build shopping lists. If you choose to link a Kroger account, Have can add items from your shopping list to your Kroger cart on your behalf. The Service is provided for personal, non-commercial use.

2. Not affiliated with Kroger

Have is an independent application. It is not endorsed by, affiliated with, or sponsored by The Kroger Co. or any of its banners (including Ralphs, Fred Meyer, King Soopers, Smith's, Fry's, QFC, Harris Teeter, Dillons, and Food 4 Less). All store names and trademarks belong to their respective owners.

3. Your account

You must provide accurate information when creating an account and keep your credentials secure. You are responsible for all activity that occurs under your account. You must be at least 13 years old to use the Service.

4. Kroger account linking and purchases

  • Linking a Kroger account is optional and happens through Kroger's own authorization flow. Your use of Kroger's services is governed by Kroger's own terms and policies, not ours.
  • You are solely responsible for your Kroger account, for reviewing your cart before checkout, and for any purchases you make. Have adds items to your cart; it never completes purchases for you.
  • Product information, prices, and availability shown in Have come from Kroger's systems and may be inaccurate, incomplete, or out of date. Always confirm prices and items at checkout.
  • We may need to suspend or change the Kroger integration if Kroger's API or its terms change.

5. Acceptable use

You agree not to misuse the Service, including by attempting to access other users' data, reverse-engineering the Service, interfering with its operation, using it to violate any law, or using automated means to access it other than through interfaces we provide.

6. Your content

You retain ownership of the data you put into the Service (your pantry, recipes, and lists). You grant us the limited license needed to store, process, and sync that data in order to operate the Service. Our handling of your data is described in our Privacy Policy.

7. Recipe and food information

Recipe matching, quantity estimates, and item recognition are provided for convenience and may contain errors. Have is not a substitute for your own judgment about food safety, allergens, dietary needs, or expiration. Always check labels and your actual items.

8. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ITEM RECOGNITION, RECIPE MATCHING, OR STORE DATA WILL BE ACCURATE.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NORTHFORM WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE WILL NOT EXCEED THE GREATER OF FIFTY U.S. DOLLARS ($50) OR THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination (including Sections 8, 9, and 12) will survive.

11. Changes to the Service and these Terms

We may modify the Service or these Terms. If we make material changes to these Terms, we will notify you through the app or by email before they take effect. Continuing to use the Service after changes take effect means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of the State of Nevada, without regard to its conflict-of-law rules. Any dispute arising from these Terms or the Service will be resolved in the state or federal courts located in Nevada, and you consent to their jurisdiction.
